Welcome to Tutu Much (“Tutu Much,” “we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your use of www.Tutu-Much.com and all related services provided through our online marketplace.
By accessing or using Tutu Much, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the website.
1. About Tutu Much
Tutu Much is an online marketplace that connects dance studios, dance organizations, businesses, and individual buyers for the purchase and sale of dance-related merchandise including, but not limited to:
- Dance costumes
- Dancewear
- Shoes
- Props
- Accessories
- Performance apparel
- Studio supplies
- Other approved dance-related items
Tutu Much is not the seller of items listed by independent vendors unless specifically stated.
2. Eligibility
You must be at least 18 years old to create an account or conduct transactions on Tutu Much.
Dance studios registering as sellers must have authority to act on behalf of their organization.
3. Account Registration
Users agree to:
- Provide accurate information
- Keep login credentials secure
- Maintain current contact information
- Be responsible for all activity under their account
Tutu Much reserves the right to suspend or terminate accounts that provide false information.
4. Verified Dance Studios
Dance studios may apply to become Verified Studios.
Verification is intended to provide additional trust within the marketplace and may require documentation confirming the business or organization.
Verification does not guarantee the quality of products or transactions.
5. Marketplace Role
Tutu Much provides the technology platform that allows buyers and sellers to connect.
Tutu Much:
- Does not inspect every item
- Does not guarantee every listing
- Does not guarantee item condition
- Does not own listed inventory (unless specifically identified)
Each seller is solely responsible for the accuracy of their listings.
6. Seller Responsibilities
Sellers agree to:
- List only items they legally own or are authorized to sell.
- Accurately describe each item.
- Upload actual photos of the item being sold.
- Disclose flaws, alterations, missing pieces, or damage.
- Ship purchased items promptly.
- Package items securely.
- Honor completed sales.
Misrepresentation may result in account suspension or permanent removal.
7. Prohibited Listings
The following may not be listed on Tutu Much:
- Counterfeit merchandise
- Stolen property
- Copyright-infringing items
- Unsafe products
- Hazardous materials
- Weapons
- Illegal goods
- Adult content
- Alcohol or tobacco products
- Prescription medications
- Animals
- Services unrelated to dance
- Any item prohibited by law
Tutu Much reserves the right to remove listings at any time.
8. Pricing
Sellers determine their own pricing.
Studios may choose to offer:
- Studio-only pricing
- Public pricing
- Bulk discounts
- Promotional pricing
All prices must be listed in U.S. Dollars unless otherwise approved.
9. Marketplace Commission
There is no fee to create an account or list items.
Tutu Much earns a 10% commission on completed sales.
Payment processing fees charged by third-party payment providers may also apply.
Tutu Much reserves the right to modify commission rates with advance notice.
10. Payments
Payments are processed through approved third-party payment processors.
Tutu Much does not store complete credit card information.
Seller payouts will be distributed according to the payment processor’s schedule.
11. Shipping
Each seller selects their shipping preferences.
Options may include:
- Flat Rate
- USPS
- UPS
- FedEx
- Local Pickup (if enabled)
Shipping costs are determined by the seller.
Buyers are responsible for reviewing shipping costs before purchasing.
12. Returns & Refunds
Returns and refunds are governed by the Tutu Much Refund & Returns Policy.
By purchasing through Tutu Much, buyers agree to that policy.
13. Intellectual Property
Users may only upload photos and content they own or have permission to use.
By uploading content, you grant Tutu Much a non-exclusive, royalty-free license to display, market, and promote your listings across our website, social media, and advertising channels for the purpose of promoting the marketplace.
Ownership of your original content remains with you.
14. User Conduct
Users agree not to:
- Harass other users
- Use abusive language
- Circumvent the marketplace
- Attempt to complete transactions outside Tutu Much after making contact through the platform
- Upload malicious software
- Attempt unauthorized access
- Manipulate ratings or reviews
- Create fake accounts
15. Reviews
Buyers and sellers may leave reviews after completed transactions.
Reviews must be:
- Honest
- Respectful
- Based on actual transactions
Tutu Much may remove reviews that violate these Terms.
16. Account Suspension
Tutu Much reserves the right to suspend or terminate accounts that:
- Violate these Terms
- Repeatedly receive valid complaints
- Sell counterfeit merchandise
- Abuse the dispute process
- Engage in fraudulent activity
- Attempt to avoid marketplace fees
17. Limitation of Liability
To the fullest extent permitted by law, Tutu Much is not liable for:
- Product defects
- Item condition
- Shipping delays
- Lost packages
- Incorrect sizing
- Seller misrepresentations
- Buyer misuse
- Lost profits
- Indirect or consequential damages
Our maximum liability shall not exceed the amount paid for the transaction in question.
18. Indemnification
You agree to indemnify and hold harmless Tutu Much, its owners, employees, contractors, affiliates, and partners from any claims, damages, losses, liabilities, or expenses arising from:
- Your use of the marketplace
- Your listings
- Your purchases
- Your violation of these Terms
- Your infringement of another party’s rights
19. Intellectual Property Rights
All Tutu Much branding, logos, graphics, website design, software, text, and marketplace features are the property of Tutu Much and may not be copied or reproduced without written permission.
20. Privacy
Your use of Tutu Much is also governed by our Privacy Policy.
21. Third-Party Services
Tutu Much may integrate with third-party providers including payment processors, shipping carriers, analytics tools, and social media platforms.
We are not responsible for the policies or services of third parties.
22. Changes to These Terms
We may update these Terms periodically.
Changes become effective upon posting on the website.
Continued use of the marketplace constitutes acceptance of the revised Terms.
23. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the State of Michigan, without regard to its conflict of law principles.
24. Dispute Resolution
Before initiating legal action, users agree to contact Tutu Much in good faith to attempt to resolve any dispute.
If a dispute cannot be resolved informally, it shall be resolved through binding arbitration or in the appropriate courts located in Berrien County, Michigan, unless otherwise required by applicable law.
